Happy Veterans Day, Election Update, and New Fire Sprinkler Article

First of all, we want to wish all of our veterans a Happy Veteran’s Day. Thank you for your service, which has afforded us so many freedoms, including the right to fair and free elections.
While much of the attention has been on the national races, I want to take this opportunity to highlight the results of some important races on the local level that will have an impact on community association legislation to be considered during the 2017 Legislative Session.

Florida Senate

District 17: Debbie Mayfield, a current House member, was elected to a Senate seat. She has been a strong advocate for community associations.

District 22: Kelli Stargel, the Senate sponsor of the “estoppel bill” was re-elected to the Senate.

District 28: Kathleen Passidomo, a current House member, was elected to the Senate. She has been involved with a number of bills impacting community associations and last year sponsored a bill which would have exempted HOA covenants and restrictions from the Marketable Record Title Act (MRTA).

District 37: Current House member Jose Javier Rodriguez defeated current Senator Miguel Diaz de la Portilla. Senator Diaz de la Portilla was the Chair of the Senate Judiciary Committee, which is one of the committees that regularly hears community association bills. While we will miss Senator Diaz de la Portilla, we are excited to be able to continue to work with Rep. Rodriguez.

Florida House of Representatives

District 42: Mike La Rosa was re-elected to the House. He sponsored a bill that would have imposed a number of changes on HOA operations and procedures.

District 43: John Cortes was re-elected to the House. He is a proponent of additional oversight for HOAs.

District 65: Chris Sprowls was re-elected to the House. He is a proponent of additional legislative changes to the condominium termination statute.

District 93: George Moraitis, who has sponsored a number of CALL initiatives, was re-elected to the House.

District 116: Jose Felix Diaz was re-elected to the House. He is a proponent of legislative changes for condominium associations.

New Fire Sprinkler Opt Out Article

The fire sprinkler retrofitting requirement and opt out law are still causing much confusion. Click here to read a new article by Becker & Poliakoff Shareholder Donna Berger: “To Take or Not to Take the Sprinkler Opt-Out Vote?”

Have a wonderful day and make sure to thank a veteran for their service.
